Sales & Rentals Closing Checklists


COMMISSION STRUCTURE/ Membership

COMMISSION STRUCTURE/ FEE MEMBERSHIP 

  • Fee Membership = Independent contractors of Arenastate LLC that select to become members of the 400 Club MUST Qualify and they will keep 100% of their commission after they pay their monthly membership fee of $400.00. 400 Club Members will pay a flat fee of $400.00 a month which will be automatically withdrawn from their bank account on file. Independent contractors that select to pay the membership fee will operate on a 50/50 Split until their $400.00 monthly membership fee is paid and members must remain active under Broker James Arena to qualify to pay their membership fee. 

  • Commission Structure Membership = Independent contractors of Arenastate LLC that select to join under our commission structure membership option will be on a sliding scale commission structure which will be outlined in their independent contractor agreement. Independent Contractors will operate on a 50/50 split if no commission structure is established and members must remain active under Broker James Arena for their commission structure to remain established. 

COMMISSION ON REFERRALS/TRANSFERS

  • Commissions paid by the broker on referrals or transfers are handled on a case by case basis. However, ALL transfers and referrals MUST be approved by the broker prior to any active or pending deals being transferred or referred for any reason to another agent within Arena And Company or to another broker/company


ADVERTISING

  • If you are going to run any advertisement related to Real Estate you must have the following words on the advertisement. ”ARENA AND COMPANY, Licensed Brokerage”

  • FREC REQUIRES “ARENA AND COMPANY, LICENSED BROKERAGE” TO BE THE SAME SIZE AS AND ABOVE THE AGENT NAME OR CONTACT INFO.

  • All Real Estate agents Agree to follow FREC guidelines for any and all advertising.

  • All Real Estate agents Agree to follow MLS and NAR guidelines for any and all advertising.

  • False advertising or misleading advertising will lead to an immediate termination of employment.

  • If you have your own designs produced by any source other than Arena And Company you must get an authorization letter signed by the Broker of record to use such items.

  • When advertising a listing that is not your own listing, you must verify on the MLS that any broker is allowed to advertise the property.

  • All of the following items including but not limited to a blog, vlog, video, social media post, advertisement, marketing tool, virtual tour, banner ad, poster, flyer, for sale sign, for rent sign, open house sign, bench sign, digital cards, YouTube videos, or any and all other types of advertising related to Real Estate must have the words: Arena And Company, Lic. Brokerage displayed according to FREC guidelines.

  • IF YOUR CONTACT INFORMATION APPEARS ANYWHERE RELATED TO REAL ESTATE, YOU MUST ALSO INCLUDE THE WORDS ARENA AND COMPANY, LIC. BROKERAGE.

  • All Real Estate agents with Arena And Company understand and agree that they will take full legal and financial responsibilities for all of their actions related to Real Estate in any way including but not limited to Advertising.

  • Only Broker James M. Arena can advertise in Briny Breezes Florida. Any associate that advertises in Briny Breezes Florida will be terminated immediately. Associates that violate this policy, will forfeit any and all listings as well as any and all commissions owed to said associate.


CREDIT AND BACKGROUND

  • A Rental Application is required to order a credit and background check.

  • The Rental Application can be found on your personal company website as well as our Arena and Company website.

  • Direct your customer to fill out the Rental Application and order a Credit and Background check if they can not obtain one on their own.

  • The Rental Application is assigned to your email address so you get a copy immediately.

  • It is important you forward the Rental Application to REBrokerJames@gmail.com when it comes into your inbox as we can not run the reports without this information.

  • It is $60 for an individual credit and background check and $100 for a Couple.

  • You will be paid $10 for every person that you run a credit and background check for.

  • Agents are paid every Friday for credit and background checks via direct deposit.

  • We do not offer refunds for any reason, however, you can personally offer a refund and deduct it from your commission if you choose to.


deposits

  • Arena And Company DOES NOT HOLD ESCROW DEPOSITS FOR SALES.

  • The Title Company facilitating the closing will hold any escrow deposits for sales transactions.

  • We hold deposits for Rental transactions and commission payments for all deals. We only hold commission payments if the deal is already closed and the agent is ready to be paid.

  • Agents are to only deposit clear funds like cash, cashiers checks or money orders.

  • Agents are to put their name on the corner of the deposit slip.

  • A Deposit Verification form must be completed immediately after any deposit is made INTO OUR ESCROW ACCOUNT.

  • In order to be paid on COMMISSIONS that are deposited, a Disbursement Order Should also be Immediately submitted for faster payment.

  • You can find the Deposit Verification Form on the agent dashboard.

  • Bounced or canceled checks deposited into the Arena And Company escrow account will cost the agent who deposited the checks $50.00 per check and this fee is subject to change based on the banks fees.

  • You will be supplied an account number to our Bank and can drop deposits at your convenience or you may deliver checks to the office.

  • Agents are to save the link to the Disbursement Order form and Escrow Deposit Verification form to your home screen on all your mobile devices, as well as your computer’s desktop for easy access. Feel free to ask for assistance setting this up.


LISTINGS

  • Any listing being put on the Market must have a fully executed listing agreement.

  • All listing agreements must be signed by the Broker James M. Arena.

  • Sellers pay a transaction fee of $295.00, this can only be waived by the broker. If the fee is not waived by the broker, the seller or listing agent must pay the fee. The fee will be deducted from the listing agents commission if it is not paid by the seller or waived in writing by the broker.

  • Listings obtained by the agent are able to be transferred to another broker if the agent decides to transfer his or her license at any time to another broker, however listings under contract in any capacity will not be transferred and The listing will close with Arena And Company.

  • If any agent leaves Arena And Company without giving at least a 30 day notice, all listings under contract for that agent will be transferred to an Arena And Company Agent or the broker will facilitate the remaining responsibilities in order to close the deal. The agent will not be paid a commission on these deals or a split will be dictated by the broker at his sole discretion.

  • Listings provided by the Broker may not be transferred and will be retained by Arena And Company unless the Broker decides otherwise.

  • Prior to any listings being transferred to another broker, for any reason, the seller must give notice that they are aware that their listing is being transferred and that they approve of the transfer taking place.


Transaction Fees

  • A Transaction Fee of $295.00 is to be charged to every buyer or seller that closes a transaction with Arena And Company.

  • If the customer is not willing to pay the fee or you are working with a family member or the purchase is for yourself, then the fee will be reduced to $195.00.

  • Only the Broker can waive the transaction fee and must do so in advance of the closing date.


requesting Disbursements

  1. A Disbursement Order Form must be completed in order for funds to be disbursed.

  2. Disbursement Orders can be found on the Agent Dashboard.

  3. The funds must be verified and cleared prior to us fulfilling the Disbursement Order.

  4. If an escrow check will need to be cut to a co-operating Brokerage or Landlord, the money must be cleared in the bank prior to being disbursed and the Disbursement Order must be sent at least 48 hours in advance to the General Manager or Broker.

  5. We will try to meet your needs if an emergency comes up, however, If the funds have not cleared a check can not be cut under any circumstances.


Policies on Getting Paid

  • Agents must be set up with Direct Deposit in order to be paid! It is vital you complete the banking information on the 400 Club Membership Form upon sign up, if not you will be waiting to be paid until your account is verified. If the banking information section of your 400 Club Member Information Form is not completed you may fill out the Direct Deposit Information Form on the Agent Dashboard.

  • In order to be paid a commission on a Real Estate Transaction you must first pay your membership fee and complete a Disbursement Order form, which can be found in the agent dashboard.

  • You must also turn in the minimum required documentation, which is:

    • Rentals

      • Disbursement Order

      • A Lease

      • Listing Agreement (If applicable)

    • Sales

      • Disbursement Order

      • A HUD/ Closing Statement

      • A Sales and Purchase Contract

      • Listing Agreement (If applicable)

  • You can find the the Forms on the agent dashboard. Save the link to the Disbursement order and Escrow Verification forms to your home screen on all your mobile devices as well as your computers desktop for easy access. Feel free to ask for assistance setting this up.

  • If you leave the Broker/ Arena And Company for any reason your membership fee can no longer be paid or will be refunded and you will be paid at a 50/50 split when ALL the associates pending transaction funds have cleared unless:

    • You make arrangements with the broker in writing, that is agreed to by all parties prior to transferring your license. In this case you will be paid according to the arrangements made in the written agreement.

    • The broker is required to perform tasks to facilitate closing your pending transactions, in which case compensation will be provided to the broker/ assigned associate at the brokers sole discretion.

    • Leave without giving notice or are terminated. In this case you will not be paid on pending transactions unless the broker decides otherwise.


The Town Of Briny Breezes

  • Real Estate Transactions in The Town of Briny Breezes are represented exclusively by Broker James M. Arena.

  • No associate that works for Arena and Company may sell, list, market to or for or represent any party in any Real Estate transaction in Briny Breezes Florida, for any reason.

  • If any associate has a unique circumstance and gets written approval from Broker James M. Arena, that associate may proceed according to the special arrangements made by Broker James M. Arena in writing.

  • A minimum of 50% of that associate’s portion of any commission offered will be paid to Broker James M. Arena in any circumstance where said agent sells or represents any party in any Real Estate transaction in Briny Breezes Florida, only if a special arrangement has been made in advance and signed by all parties.

  • If any associate violates this policy, they will be terminated effective immediately upon the brokerage finding the violation.

  • Every associate agrees in advance by signing their independent contractor agreement to forfeit all their Listings active or pending (Not just those in Briny Breezes) and all pending commissions/buyer contracts to Broker James M. Arena upon termination due to a violation in regards to the Town of Briny Breezes.
